1. Acceptance of Terms

By downloading, installing, or using the FinaPrism application ("the Service"), you unconditionally accept these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding contract between you ("the User") and FINAPRISM, a French simplified joint-stock company (SAS) with share capital of €1,000, registered with the Paris Trade and Companies Register under number 106 820 145, whose registered office is at 229 rue Saint-Honoré, 75001 Paris ("FinaPrism", "we", "our") — full details in the Legal Notice. Continued use of the Service after any modification to these Terms constitutes acceptance of the new terms; if you do not accept the modifications, you may terminate free of charge before they take effect.

You represent that you are of legal age and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a legal entity, you warrant that you have the authority to bind that entity.

2. Service Description

FinaPrism is a personal finance management mobile application available on iOS. The Service allows users to:

• Manually track their accounts, income, and expenses;

• Import bank statements (CSV/PDF) or text to automatically extract the transactions;

• Create and manage personalized budgets;

• Visualize their finances through charts and dashboards;

• Convert currencies (298+ supported currencies);

• Benefit from automatic transaction categorization.

The Service is offered in a free version and a paid Premium version. Features vary depending on the version used.

3. User Account

You must create a user account to use the Service. You agree to provide accurate, complete, and up-to-date information when creating your account.

You are fully responsible for maintaining the confidentiality of your login credentials. Any activity conducted through your account is deemed to be your own. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account in case of a serious breach of these Terms, proven fraud, or any act compromising the security or integrity of the Service or its users, under the conditions set out in Article 11.

4. Premium Subscription

FinaPrism offers a Premium subscription providing advanced features: unlimited budgets, PDF/spreadsheet export, subscription tracking, digital receipts, automatic categorization, and up to 100 accounts.

Subscriptions are offered in two plans: monthly and yearly. Prices are clearly displayed in the application and may vary by geographic region.

All subscriptions are managed exclusively through Apple's App Store. Payment is charged to your iTunes account upon purchase confirmation. The subscription automatically renews unless canceled at least 24 hours before the end of the current period.

You can manage or cancel your subscription at any time in your Apple account settings (Subscriptions section), in a single operation.

Right of withdrawal: under Articles L221-18 et seq. of the French Consumer Code, you generally have a 14-day withdrawal period. However, as the subscription concerns digital content supplied immediately, under Article L221-28, 13° of that Code you expressly request that performance begin upon purchase confirmation and acknowledge that you thereby lose your right of withdrawal as soon as performance begins. As Apple acts as the seller, refunds are handled by Apple under the App Store terms; no other refund is due for the current period, unless mandatory law provides otherwise.

Renewal (Article L215-1 of the French Consumer Code): for an annual subscription, you are informed, no later than one month before the non-renewal deadline, of the option not to renew. You may cancel at any time, free of charge and in a few clicks, from the Subscriptions settings of your Apple account (Article L215-1-1).

Free trial periods, if offered, are limited to one per user. At the end of the trial period, the paid subscription starts automatically unless canceled beforehand.

We reserve the right to modify subscription pricing. In case of modification, you will be informed in advance and will have the option to cancel your subscription before the new pricing takes effect.

5. Third-Party Services

The Service integrates third-party services for certain features:

• Apple: for subscription and payment management via the App Store. Apple's terms apply. The application is licensed, not sold; absent a specific license agreement, it is governed by Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). Apple is not a party to these Terms, assumes no warranty, maintenance or support obligation for the application, and is a third-party beneficiary entitled to enforce them.

• Google (Google Ireland Limited / Google LLC): transaction categorization and extraction of transactions from the statements (CSV/PDF) and receipts you import. Depending on the feature, either transaction descriptions or the entire content of the imported document (which may contain identifying data) is transmitted; this processing may involve a transfer outside the European Union covered by appropriate safeguards (Standard Contractual Clauses and/or EU-US Data Privacy Framework). By using features related to these third-party services, you accept their respective terms. We encourage you to review the privacy policies of these services.

6. Privacy and Data Protection (GDPR)

FinaPrism is committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR — EU Regulation 2016/679) and applicable data protection laws.

The data collected, processing purposes, legal bases, retention periods, and your rights are detailed in our Privacy Policy, which forms an integral part of these Terms.

We do not sell or monetize your personal data. No banking or financial data is used for advertising or commercial purposes.

7. Data Security

FinaPrism implements advanced technical and organizational measures to ensure the security of your data:

• Communication encryption via TLS (Transport Layer Security);

• Encryption of data at rest with Halite/libsodium (public-key authenticated encryption);

• Secure storage of sensitive data via iOS Keychain;

• Secure and encrypted backups;

• Strong authentication and secure session management.

Despite these measures, no system is entirely invulnerable. You are also responsible for the security of your device and credentials.

8. User Obligations

By using the Service, you agree to:

• Not use the Service for illegal, fraudulent, or unauthorized purposes;

• Not attempt to access data or features you are not authorized to access;

• Not disrupt the operation of the Service, including by sending viruses or malicious code;

• Not extract, copy, or reuse a substantial portion of the Service content without authorization;

• Provide accurate information and keep it up to date.

Any violation of these obligations may result in the immediate suspension or termination of your account, without prejudice to any legal action.

9. Intellectual Property

FinaPrism owns all intellectual property rights relating to the Service, including but not limited to: source code, design, user interface, graphics, logos, trademarks, texts, and databases.

Use of the Service does not grant you any intellectual property rights over these elements. Any unauthorized reproduction, modification, distribution, or exploitation is strictly prohibited.

The data you enter into the Service (transactions, budgets, categories, etc.) remains your exclusive property. FinaPrism claims no ownership rights over your personal or financial data.

The trademarks Apple, App Store, and Google are the property of their respective owners.

Likewise, the logos and trademarks of banks, financial institutions and merchants that may be displayed in the Service remain the property of their respective owners and are used solely for identification purposes, without implying any partnership, affiliation or endorsement. Any owner may request the removal of its trademark or logo at contact@finaprism.com.

10. Limitation of Liability

Without prejudice to the legal guarantee of conformity and the mandatory provisions protecting consumers, the Service is provided "as is" and "as available". FinaPrism does not guarantee that the Service will be uninterrupted, error-free, or completely secure.

Legal guarantee of conformity: regardless of these provisions, the consumer User benefits from the legal guarantee of conformity provided for in Articles L224-25-1 et seq. of the French Consumer Code applicable to digital content and services. Accordingly, the User may obtain the Service brought into conformity, free of charge and without major inconvenience. This guarantee cannot be waived, and the limitations below apply without prejudice to it.

FinaPrism shall not be held liable:

• For financial decisions made by the User based on information provided by the Service. FinaPrism is not a financial advisor and the Service does not constitute financial advice;

• For service interruptions due to events beyond our control (force majeure);

• For indirect, incidental, or consequential damages arising from the use of the Service.

Our liability is limited, to the fullest extent permitted by applicable law, to the amount you have paid for the Service during the twelve months preceding the event giving rise to liability.

These limitations and exclusions do not apply to the consumer to the extent they would reduce the consumer's right to compensation for loss resulting from a failure by FinaPrism to meet its obligations, nor do they affect the consumer's rights under mandatory provisions and the legal guarantee of conformity. They likewise do not apply in cases of gross negligence, willful misconduct, or personal injury.

11. Termination

You may stop using the Service at any time. Deletion of your account results in the permanent deletion of your data, subject to legal retention obligations.

We may suspend or terminate your account in case of a serious breach of these Terms, fraudulent use, or any act compromising the security or integrity of the Service. Except in an emergency or where required by law, termination is preceded by a prior formal notice that has remained without effect. Where termination is initiated by FinaPrism in the absence of any fault by the User, the unused prepaid portion of the subscription is refunded, such refund being handled by Apple under the App Store terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including clauses relating to intellectual property, limitation of liability, and governing law) remain in effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Modifications take effect upon their publication in the application.

For substantial modifications, we will inform you by email (if you have provided an address) or by notification in the application at least 15 days before they take effect.

Your continued use of the Service after modifications take effect constitutes your acceptance of the new terms. If you do not accept the modifications, you must stop using the Service.

13. Governing Law

These Terms are governed by French law. Any dispute shall be brought before the competent French courts; however, if you are a consumer residing in another European Union country, this clause applies without prejudice to the mandatory protective provisions of the law of your country of habitual residence or to your right to bring proceedings before the courts of that country.

If any provision of these Terms is declared void or unenforceable, the remaining provisions shall remain in full force and effect.

FinaPrism's failure to enforce any breach of these Terms does not constitute a waiver of its right to subsequently enforce such breach.

These Terms constitute the entire agreement between you and FinaPrism regarding the Service and supersede all prior agreements.
